Wellplace Terms and Conditions

Wellplace may modify these Terms and Conditions at any time. Your original acceptance obligates you to review these Terms and Conditions periodically to be aware of any modifications. If such modifications are material, you will be given the opportunity to opt-out of further use of the site and delete personal information you have provided to us.

Public Forums
If you participate in a public forum (e.g., a chat room, live seminar, bulletin board, or discussion group), you are solely responsible for your own communications, the consequences of posting those communications and your reliance on any communications found in a public forum.

To prevent misuse of our site, users must follow the rules below. If you participate in any of Wellplace's public forums, you agree:

  • Not to post material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others.

  • Not to post material that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by Wellplace in its sole discretion.

  • Not to post advertisements or solicitations of business.

  • Not to post chain letters or pyramid schemes.

  • Not to impersonate another person.

  • Not to interfere with another user's participation in a forum.

  • Not to post or transmit any file which contains viruses, worms, Trojan horses or other contaminating or destructive features.

  • Not to allow any other person or entity to use your identification for posting or viewing comments.

Wellplace reserves the right to take any action it deems necessary to protect the personal safety of our users or the public. Specifically, Wellplace reserves the right (but is not obligated) to:

  • Monitor the dialogue in public chat rooms.

  • Investigate an allegation that a communication does not comply with these Terms and Conditions and remove or request the removal of the communication

  • Remove communications which are abusive, illegal, or disruptive; and
    Terminate a user's access to any or all-public forums upon any breach of these Terms and Conditions.

Your use of public forums is at your own risk. In cases where you feel threatened or believe someone else is in danger, contact your local law enforcement agency immediately.

Advertisements And Links To Other Sites
Wellplace may contain links to web sites operated by other parties. Wellplace does not endorse or make any representations about the content on any other web sites or third party advertisements, and does not make any representations regarding their content or accuracy. Your use of other web sites is subject to the terms and conditions of use for those sites. Wellplace also does not endorse any product advertised on the Wellplace site or otherwise.

Copyright Obligations
You may download or print a copy of information found on the Wellplace site for your personal use only. Reprinting or electronically reproducing any document or graphic in whole or in part for any other purpose is expressly prohibited, unless prior written consent is obtained from the respective copyright holder(s). Indemnification
You agree to defend, indemnify and hold Wellplace, its officers, directors, employees, agents, licensors and suppliers harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from your violation of these Terms and Conditions.

Jurisdiction
You agree that exclusive jurisdiction for any dispute with Wellplace, or in any way relating to your use of Wellplace, resides in the courts of the State of Massachusetts. The internal substantive laws of the State of Massachusetts govern these Terms and Conditions. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions. No waiver of any of these Terms and Conditions shall be deemed a continuing waiver of such term or condition or any other term or condition.

Wellplace Disclaimer

In no event is Wellplace liable for any direct, indirect, incidental, consequential, special, punitive, or any other monetary or other damages, fees, fines, penalties, or liabilities relating to use of Wellplace, or other sites accessed through Wellplace. Wellplace makes no representations or warranties about the accuracy, reliability, completeness, or timeliness of the information, Content, software, text, graphics, links, or communications provided on or through the use of Wellplace. A user's sole and exclusive remedy for dissatisfaction with Wellplace.com is to desist from using the web site.

When using Wellplace, information is transmitted over a medium that is beyond the control of Wellplace. Therefore, Wellplace assumes no liability for or relating to the delay, failure, interruption or corruption of any data or other information transmitted in connection with use of Wellplace.

Use of this site constitutes an understanding and acceptance of the foregoing provisions.

INFORMATION PRACTICES REGARDING CHILDREN UNDER 12

The information that Wellplace may obtain from a child includes name, address, age, date of birth, sex, email address, and telephone number. Information obtained from a child will be used exclusively by Wellplace for the purposes of record keeping and rendering services specifically requested by the child. There will be NO information disseminated to third parties.

PARENTAL CONSENT
Consent from a parent or legal guardian is REQUIRED before Wellplace will agree to render services or forward marketing materials to a child. When a child under 13 years of age contacts Wellplace to request information or services, such child will be required to furnish the name, address and phone number of a parent or legal guardian. The parent will then be notified by a Wellplace staff member to obtain the necessary consent to hold and use the child's information for the purposes stated above. If, after a reasonable period of time, a parent's information is not furnished by a child, or if the consent is not provided by the parent, all information pertaining to the child will be deleted and the child will not be permitted to participate in any online events held by Wellplace that require obtaining and using the child's personal information.

In the event the parent provides consent, it can later be revoked at any time by the parent contacting Wellplace and specifically requesting that the information be deleted or the use of a child's personal information be limited. If a parent's request for limitation on the use of information is found to be impractical or not feasible, Wellplace reserves the right to refuse to render services and/or forward marketing materials to a child and, upon such refusal, will delete all information obtained from the child.
